Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY022217), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA).

The facility has an average design flow of 0.19 mgd and discharges treated sewage wastewater via Outfall 001 to the Normans Kill, a class B water.

Treatment at the facility includes grinder/bar rack, equalization tanks, activated sludge tanks, spiro-flow clarifier, sand filters and UV treatment.

The following changes to the permit are proposed: Added monitoring requirements for Temperature and Copper, added a new Chlorine limit, and decreased the summer and winter Ammonia limits. When the Department updates a permit this typically includes updated forms incorporating the latest general conditions.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes a discharge of 6,625 GPD of treated sanitary wastewater to a Tributary of the Black Creek, a Class C waterbody from a primary treatment plant at the applicant's facility located at Camp Wildwood 1212 Leesome Lane, Altamont NY. The applicant plans to construct and operate a new wastewater treatment system which uses synthetic media filters, re-circulation tanks and an UV disinfection system to replace the current, outdated sand filter system. The department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Applicant proposes to demolish and rebuild an existing residence. The new residences footprint will be 366 sq. ft larger than the existing and includes a concrete foundation and deck. No new bedrooms or bathrooms are proposed. Existing septic system will be replaced. Some of the excavated topsoil will be placed on 3 small, rocky portions of existing yard and driveway. All work occurs in the adjacent area of freshwater wetland K-109, Kinderhook Lake. Project located at 39 Eberle Rd.
