Project Description:

The Department has prepared a draft permit and made a tentative determination to approve a proposed modification to State Pollutant Discharge Elimination System (SPDES) permit No. NY-0000906 for NFB Carbon Products, LLC. This is a storm water SPDES permit.

In December 2015, NFB Carbon Products sold the structures and property located at 6050 Niagara Falls Blvd to Ashland Advanced Materials [AAM], LLC. NFB Carbon still owns the 6000 Niagara Falls Blvd. property to the west of the AAM, LLC site. NFB Carbon does not manufacture at this site.

This permit modification will be to delete the Outfalls [001, 002, 003, and 008] located at the 6050 Niagara Falls Blvd location from the NFB Carbon SPDES Permit. These Outfalls will subsequently be added to an updated AAM SPDES Permit. Stormwater Outfall 007 will remain on the updated NFB SPDES Permit and includes limits for conventional stormwater parameters. Outfall 007 is surface runoff that is collected in a grass lined ditch to the north of the property flowing west to east from some covered and vegetated industrial/commercial debris and concrete pad areas. This proposed modification also includes Industrial BMP requirements which focus on the minimization of metals and PAHs in the surface runoff. A Schedule of Submittals is included requiring the submission of a BMP Plan, yearly progress summary and yearly sampling/testing for these parameters.

As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit for the Morton Salt facility located at 454 Ribaud Avenue, Silver Springs, New York. Morton Salt, Inc. produces, packages, and ships evaporated sodium chloride salt products. This Air State Facility permit is proposed to replace the existing Title V Air permit for this facility because facility emissions have been reduced below major source thresholds following conversion of the coal-fired boiler to a natural gas-fired boiler. A new natural gas 148 MMBtu/hr steam boiler and eight small direct fired building heaters replaced a 138 MMBtu/hr coal boiler and a 92.5 MMBtu/hr natural gas boiler. Morton Salt must maintain the facility oxides of nitrogen (NOx) emission limit created during the netting analysis of the boiler conversion project. The total NOx emissions from Emission Unit M-BG003 including the 148 MMBtu/hr natural gas boiler and the eight new direct fired building heaters shall not exceed 47.2 tons per year (tpy) NOx on a rolling 12-month basis. In addition, Morton Salt used 7.5 tpy NOx Emission Reduction Credits (ERCs) during the netting analysis of the boiler conversion project that cannot be used again. The new large boiler is subject to the relevant presumptive RACT emission limit of 0.06 pounds NOx per million Btu burning only natural gas, 40 CFR 60 Subpart Db - Standards of Performance for Industrial-Commercial-Institutional Steam Generating Units and 40 CFR 63 Subpart DDDDD - National Emission Standards for Hazardous Air Pollutants for Major Sources: Industrial, Commercial, and Institutional Boilers and Process Heaters.

As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance. A draft permit is available for review.
