Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the Air State Facility permit for Fishkill Downstate Correctional Facility.

This modification serves to add three 17.57 MMBtu/hr, natural gas-fired Unilux boilers to the permit. These boilers will be located in the Downstate powerhouse, each with a separate stack. VOC emissions from the spray booths have also been limited to 2.5 tpy in order to cap out of 6 NYCRR Part 228.

The Fishkill Downstate Correctional Facility is located in Dutchess County, NY. Two separate boiler plants are used to meet the heating needs of the two campuses. The Fishkill powerhouse contains four 55 MMBtu/hr boilers firing natural gas and No. 6 fuel oil. The Downstate powerhouse is in the process of adding three 17.57 MMBtu/hr, natural gas-fired boilers. Until this boiler project for the Downstate facility is completed, one 34 MMBtu/hr, No. 2 oil-fired boiler remains on site (since 2014) providing steam to the Downstate facility as necessary. Additional facility sources include two paint spray booths, four diesel generators in the Coordinated Demand Response Program and three diesel generators used strictly for emergency purposes.

The facility is subject to requirements under 6 NYCRR Parts 201, 211, 225, 227, and 40 CFR Parts 60 and 63.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 750 gallons per minute of water from an on-site well for golf course irrigation. The facility has been in operation since at least 2011. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The Town of North Castle proposes to disturb approximately 4,876 SF of NYS Freshwater Wetland K-29, Class 1, within the 100 foot adjacent area, for the constuction of a gravel access road, and repair and maintenance activities to the Dam that impounds Duck Pond (Tribs of Mianus River, Waters Index No. CT-4-16A-P1108M, Class AA-S). An 8 foot wide gravel acess road will be installed from Long Pond Road to the dam. Trees along the face of the dam will be flush cut; the existing concrete spillway walls will be repaired; and an eroded low area at the dam face will be filled.
