Negative Declaration

Broome County - The Town of Chenango, as lead agency, has determined that the proposed Model Solar Energy Law 2016 will not have a significant adverse environmental impact. The Town of Chenango, pursuant to the Municipal Home Rule Law and recommendations of the Town's Comprehensive Plan, will add Chapter 67 "Solar Energy Law" to their municipal code. Adoption of this chapter will provide zoning protections to advance and protect the public health, safety, and welfare of the Town of Chenango. This is in an effort to aid in taking advantage of renewable energy (electricity generated predominantly by use of photovoltaic systems), efforts to decrease energy costs, and to bolster employment and business development for both residential and commercial entities.

In general, this law defines a difference between residential and commercial solar energy systems; sets the agricultural zoning district as the zoning district area allowing ground mounted solar energy systems by right as either principal or accessory uses with a specific set of land use criteria; establishes the building permit and site plan application procedures for solar energy systems; establishes decommissioning terms for commercial solar systems; and allows rooftop solar energy systems by right as an accessory use in all zoning districts (each zoning district attachment land use table to the Town code is to be altered as such). Chapter 19 - Fees will be updated accordingly.

The project is located throughout the Town of Chenango, New York.
