Notice of Second Legislative Public Comment Hearing for Town of Colonie Landfill

The New York State Department of Environmental Conservation (NYS DEC) prepared a Combined Notice of Completion of Draft Environmental Impact Statement (DEIS), Notice of Complete Applications, Notice of Public Comment Period and Notice of Legislative Public Comment Hearing for the Town of Colonie and Capital Region Landfills, Inc. proposal to develop approximately 132 acres of land (referred to as Area 7) within the existing 212 acre landfill site as new landfill space. The Notice was initially published in the Environmental Notice Bulletin, and in the Times Union newspaper on August 24, 2016 with a deadline date for written comments from the public on the applications to be received by the NYS DEC by October 7, 2016. On September 21, 2016 NYS DEC published a new Notice that extended the deadline for receiving written comments until November 1, 2016: http://www.dec.ny.gov/enb/20160921_not4.html.

A Legislative Public Comment Hearing on the applications was held on September 20, 2016, at the Shaker High School auditorium where unsworn oral statements about the proposal were received from the public.

Notice is hereby given that a second Legislative Public Comment Hearing regarding this proposed landfill project is scheduled for Tuesday, October 25, 2016 at the Shaker High School auditorium, located at 445 Watervliet Shaker Rd, Latham, NY, starting at 6:00 p.m. to receive unsworn statements from the public.

Public Hearing and Written Comment Period:

All persons, organizations, corporations or government agencies which may be affected by the proposed project are invited to comment on the applications.

All persons having an interest in this project are urged to attend or be represented either individually or collectively. It is not necessary to file a written request in advance to speak at the legislative hearing. Written statements and comments on the application are encouraged, and any statements and comments may be filed prior to, or at the hearing, but no later than the deadline for written comments, which is Tuesday, November 1, 2016. Written comments must be submitted to the attention of: Angelo Marcuccio, NYS DEC - Region 4 Office, 1130 North Westcott Rd., Schenectady, NY 12306. The Administrative Law Judge (ALJ) may limit the time available for oral comments to 3 minutes per person to ensure that all persons have an opportunity to be heard.

This hearing location is reasonably accessible to persons with a mobility impairment. Translator services shall be made available, at no charge, upon written request to the ALJ. All requests must be made to the NYSDEC Office of Hearings and Mediation Services, ALJ Molly T. McBride, 625 Broadway, First Floor, Albany, New York, 12233-1550, Phone: (518) 402-9003. The request must be received no later than 4:00 p.m. on October 19, 2016.

Following the hearing, NYS DEC will make a determination on whether substantive or significant issues have been raised as defined in 6 NYCRR Part 621 Uniform Procedures, and an Adjudicatory Public Hearing should be scheduled before an Administrative Law Judge. In order to raise substantive and significant issues, written comments expressing objections to or opposition to the application must explain the basis of that opposition and identify the specific grounds which could lead the Department to deny or impose significant permit conditions on the project.
