Project Description:

The New York State Department of Environmental Conservation has prepared a draft permit and made a tentative determination to issue a modification to the City of Fulton's State Pollutant Discharge Elimination System (SPDES) permit for the surface discharge of treated wastewater to the class B Oswego River from the Fulton Water Pollution Control Plant.

The City of Fulton has requested to modify their SPDES permit to install a flow meter over the weir of a chlorine contact tank located on the effluent side of the plant. The current permit requires monitoring on the influent side. The new location will allow for more accurate measurements and easier periodic calibration. The plants permitted discharge volume and limits will not change. SPDES # NY0026301

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to expand a currently permitted 7.27 acre sand and gravel mine by 3.87 acres, increasing the Life of Mine to 11.14 acres. The modification proposal includes the use of a crusher for material processing, as well as expanding operating hours to allow mining from 7 A.M. to 12 P.M. on Saturdays. Mining will proceed below the water table, and reclamation will include the creation of a 6 acre pond, and upland areas of revegetated meadows. The application and plans are available for review at the Region 7 NYSDEC office.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
