Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0077593), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The facility has a design capacity of 38,000 gpd. Treatment consists of septic tank, equalization tank, rotating biological contactors, secondary clarifiers, sand filters, chlorine disinfection system, and post aeration tank. The treated wastewater discharges via Outfall 001 to an unnamed sub-tributary of Wappinger Creek, a class B water.

The following changes to the permit are proposed: Permit pages, conditions, and footnotes have been updated, renumbered and reordered, and reflect current permit language, DEC guidance, format and nomenclature. Effluent limit changes have been made based on water quality analysis. pH range has been changed. Ammonia effluent limit has been changed. An interim Total Residual Chlorine (TRC) limit is in effect until compliance with the final effluent limit for TRC in accordance with the schedule of compliance. Permit format has been updated and incorporates the latest general conditions. Details of changes are specified in the draft permit and statement of basis.

Project Description:

The applicant proposes to replace 160 linear feet of an existing bulkhead on the Hudson River (H-Portion, Class A), at the New Hamburg Terminal Corp. at 17 Point Street, New Hamburg, in the Town of Poughkeepsie, Dutchess County. The existing bulkhead consists of 4 foot steel sheet piles fastened to the tops of timber piles. The tops of the timber piles are deteriorating, reducing the integrity and use as a base for the steel sheet piles. The bulkhead is failing, causing erosion problems behind the structure. New 43 foot sheet piles will be installed using vibratory methods in front of the existing bulkhead, and approximately 200 cubic yards of stone will be used as fill between the existing and proposed piles.

Project Description:

The above noted land owner began constructing a driveway within State Freshwater Wetland CM-23 (Class II), and its100 adjacent area, prior to obtaining necessary permits from NYSDEC and in violation of the NYS Environmental Conservation Law. As the part of the Enforcement Action taken by NYSDEC, the land owner is required to make application for an Article 24 Freshwater Wetland Permit to complete the remaining work and to provide for restoration of the natural resource as required by the NYSDEC.

The completion of the driveway will cause the physical disturbance of 0.03 acres of the freshwater wetland proper and 0.21 acres its 100 adjacent area. Restoration activities include the removal and replacement of an undersized culvert with two properly sized culverts. The purpose of the driveway is to gain access to a single family residence proposed to be constructed in an upland area not regulated by NYSDEC.

Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a renewal of the Title V permit held by the Al Turi Landfill & LFGTE facility located in Goshen, Orange County. The Al Turi Landfill & LFGTE facility consists of a combined municipal solid waste landfill, which is owned and operated by Al Turi Landfill, Inc. and an adjacent landfill gas to energy plant, which is owned and operated by Ameresco LFG-1, Inc. (Ameresco). The facility is located in Goshen, Orange County, New York and is accessed at 2690 Route 17M.

The subject of this Title V permit renewal 3 pertains to the landfill gas to energy plant owned and operated by Ameresco. Sources include a Caterpillar G3516 800 kW engine manufactured prior to 2006, a Caterpillar G3516 800 kW engine manufactured in 2009, an enclosed combustor flare and an emergency backup open flare.
The landfill last received waste in early 2003 and documented waste placement exceeds 2.5 million megagrams. Because the facility is subject to 6NYCRR Part 208, Title V permitting applies.

Both lean burn spark ignited engines are subject to NMOC control requirements under 6NYCRR Part 208. The electric generating engine manufactured in 2009 is subject to emission standards under 40CFR 60 - JJJJ. The enclosed combustor flare is also subject to NMOC control requirements under 6NYCRR Part 208.

The Standard Industrial Classification representative of this source is 4931 - Electric & Other Services Combined.


In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
