Amendments of the Final Freshwater Wetlands Maps for Erie County:

Subsequent to the promulgation of the final Freshwater Wetlands Maps for Erie County in September 1986, New York State Department of Environmental Conservation (NYS DEC) Staff found an inaccuracy affecting Map 3 of 31. Having investigated this inaccuracy, NYS DEC Staff sent notice of the proposed wetland map amendment to the affected landowners and published notice in local newspapers and in the ENB. NYS DEC Staff reviewed public comments received during the comment period and no public hearing was held. Upon review of NYS DEC Staff's findings and recommendations relative to this matter, the NYS DEC Commissioner was satisfied that Staff appropriately responded to all oral and written comments on the proposed amendment, and that Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record. The NYS DEC Commissioner ordered that Wetland TE-45, a Class II wetland, be added to Map 3 of 31 for Erie County, effective March 31, 2015. For the purposes of Wetland Map Amendment TE-45, the date of the final agency action shall be the date of publication in the ENB. A copy of the final map and wetland classification sheet has been filed with the office of the clerk of each affected local government and in the NYS DEC - Region 9 Office, Buffalo, NY.

Copies of the final maps and wetland classification sheets have been filed with the office of the clerk of each affected local government and in the NYS DEC - Region 9 Office, Buffalo, NY.

Negative Declaration

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Zoning Ordinance Text Amendment - Fraternities & Sororities will not have a significant adverse environmental impact. The action involves amendments to the Town of Amherst Zoning Ordinance to remove fraternities and sororities as allowable uses in certain zoning districts, revise the definitions, and provide standards under which they may be developed. The project is located throughout the Town of Amherst, New York.

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Zoning Ordinance Text Amendment will not have a significant adverse environmental impact. The project involves a text amendment to the Town of Amherst Town Code to include 'motor vehicle repair' as a permitted use in the General Industrial (GI) zoning district. The project is located throughout the Town of Amherst, New York.

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Rezoning of 4785 and 4795 Sheridan Drive will not have a significant adverse environmental impact. The project involves the rezoning of 3.31 ± acres from Residential District Three (R-3) to Multi-Family Residential District Five (MFR-5) to construct 10 single family townhomes on the property. The site is located on the north side of Sheridan Drive adjacent to Park Country Club and backs up to Ellicott Creek, at 4785 and 4795 Sheridan Drive in the Town of Amherst, New York.

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Amherst Bicentennial Comprehensive Plan Amendment - Youngs Road Extension will not have a significant adverse environmental impact. The proposed Comprehensive Plan amendment will add references in the Plan text and mapping to a proposed "Youngs Road Extension" that will extend between Casey Road and the Dodge / North French Road area. This extension was formerly in the Comprehensive Plan but was removed in 2015. The Amherst Town Board has now added this future thoroughfare back into the Plan. The project is located at north terminus of Youngs Road at Casey Road, extending Dodge/North French Road in the Town of Amherst, New York.
