Project Description:

The Department has received and made a tentative determination to approve an application to restore the Village of Gowanda reservoir and Point Peter Brook. The project includes the excavation of deposited silt and debris in the forebay and trash rack in Point Peter Brook and Allen Springs, the installation of a rock wall and stone rip rap to retain the banks near the trash rack, installation of a new box culvert at the access driveway over Allen Spring and dredging of approximately 6,000 cubic yards of sediment from the reservoir. The excavated soils will be placed at Zoar Valley Gateway Park and at the Village of Gowanda Palmer Street fill area. The project is located at the Gowanda Water Reservoir at 10021 Point Peter Road in the Town of Persia. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

The Department intends to issue a permit for the mining of sand and gravel from an 8.1 acre permit term area within an 8.1 acre Life of Mine facility, with occasional processing utilizing a portable dry screen only. There will be no change to the mining plan and methods as previously permitted for this site. The reclamation goal remains agriculture.
