Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,200 gallons per minute of water from an on-site pond using a closed loop system for the purpose of aggregate production. The facility has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

No further review in accordance with SHPA is required.

Project Description:

The Department has made a tentative determination to approve this application to reissue a State Pollution Discharge Elimination System (SPDES) permit which had been allowed to expire for an existing industrial surface discharge into Pochuck Creek tributary to Wallkill River, Water Index No. 139-13-63, Class 3. The permit authorizes discharge from an oil and water separator that treats stormwater runoff and tank area secondary containment drainage. There is no flow limit specified in the permit since discharge is event based. Rather, monthly monitoring limits and reporting is required, and limits are specified in the permit for oil and grease and pH, as well as action levels for other parameters. Changes from the previous permit include the addition of 0.1 action levels for BTEX to conform to Department guidance for protection of water quality. Other changes include the addition of a monitoring diagram and BMP requirements.

A SPDES permit NY 0271357 has been drafted with DEC-proposed effluent limits and monitoring requirements. The draft is available for review at the DEC Region 3 headquarters in New Paltz.

Project Description:

Timber Lakes Estates Property Owners Association, Inc. proposes repairs to Timber Estates Dam, DEC Dam ID # NY 148-4906, which impounds NYS Freshwater Wetland EL-69, Class 3, and flows into Tributaries of Delaware River, Waters Index No. D-27, 29, Class B(T). The project includes the repair of the damaged existing primary spillway drop structure and outlet pipe, and restoring operability to the low level outlet. The dam currently impounds 54 acre-feet of water. Wetland EL-69 will be temporarily drawn down in order to complete the work. Flows will be diverted by means of pumps or siphon systems directed through the exiting outlet pipe. Repairs to the dam will not change the hydraulic conditions of the spillway and low level outlet system. The total area of the site of the proposed action is 0.03 acres, and the area of wetland/lake bottom disturbance associated with the repairs is 0.005 acres. The site will be accessed along the crest of the dam.
