Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit #NY 0202959 pursuant to 6 NYCRR Part 750-1.18 and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

Bailey Manufacturing Company LLC discharges industrial process wastewaters to receiving waters known as groundwater.

The proposed modifications to this permit include the following: Water Quality Based Effluent Limitations of 5 ug/l and 8 ug/l for Di(2-Ethylhexyl) Phthalate and Total Phenols, respectively; an 18 month schedule of compliance to provide the Permittee with sufficient time to upgrade the wastewater treatment plant to treat the wastewater at or below the effluent limits of 8 ug/l and 5 ug/l for Total Phenols and Di(2-Ethylhexyl) Phthalate and Total Phenols; and a change in sample type from "24 hour composite" to "recorded", this is a correction to the previous permit.

The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. A draft permit is available for review.

Project Description:

The Department has made a tentative determination to approve an application for work within the existing boat harbor. The project includes the installation of permanent floating docks for approximately 1,100 boats secured by chains to piles driven into the lake bed, dredging of approximately 12,000 cubic yards of sediment to be disposed of at the U.S. Army Corps of Engineers confined disposal facility at the south end of the Buffalo Outer Harbor, construction of a 10 foot by 400 foot wave attenuator at the mouth of the harbor, and the construction of a 60 foot by 70 foot fuel dock with a 10 foot by 10 foot enclosed structure. The project also includes construction of five new structures along the shore to anchor dock gangways.

As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0021849).

The facility has a design flow of 1.4 mgd and discharges treated sewage through Outfall 001 to the Tonawanda Creek, a class A water. Treatment consists of a trickling filter tertiary process, using biotower trickling filters, clarifiers for solids settling, ferric chloride for phosphorus removal, chlorination, and sulfur dioxide for dechlorination. Sludge is digested, pressed, dried, and composted onsite.

DEC proposes to incorporate the following modifications to this permit: Settleable solids and Total Residual Chlorine limits have been changed and a Schedule of Compliance has been added. A Dissolved Oxygen limit has been added for summer months. A short term high intensity monitoring plan for Copper has been added. Whole Effluent Toxicity testing has been added. Summer and winter Ammonia (as N) limits have been added. Concentration monitoring for total Cadmium and Cyanide, amendable to chlorination has been added. Influent monitoring for TKN and Ammonia (as N) has been added. The permit includes updated forms and the latest general conditions.
