Project Description:

The Department has prepared a draft permit, and made a tentative determination to issue an Air State Facility (ASF) permit for the High Falls Operating Co facility, located in the City of Rochester, Monroe County.

The proposed Air State Facility Permit for an existing brewery facility. The facility has previously operated under Certificates to Operate, and no operational changes are being proposed. Emissions are from brewhouse operations and a natural gas boiler, which has a capacity to use #6 fuel oil. The facility operates under a federally enforceable emissions cap that limits NOx and SOx to less than 100-tons per year. Record-keeping of the quantities of the natural gas and #6 fuel oil burned will be required to verify compliance. These facility emission caps will ensure that the emission thresholds for a major source of air contamination are not exceeded.

The Department has made a tentative determination to issue a Modification to the RG&E Brooks Avenue Corrective Action RCRA Only Permit to select the final remedy for Groundwater Contamination and Soil Vapor (Operable Unit 2). Based on the site investigation results, evaluations and the completed interim corrective measures, DEC is proposing No Further Action with continued site management. The revised draft modules associated with the Corrective Action related to the Groundwater and Soil Vapor remedy are available for review and comment along with the Fact Sheet, the draft permit and the draft Statement of Basis. Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 800 gallons per minute of water from an on-site well and irrigation pond for golf course irrigation. The facility's water withdrawal system has been in operation since 2000. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
