The permittee will be required to maintain records to verify compliance with the SPDES permit conditions and discharge limits.

The applicant proposes reconstruction of the dam impounding Wells Pond, which extends from the Town of Highland to the Town of Bethel, including the removal of the remnant structure which requires excavation in to Wells Pond (NYS Waters Index # D-25-183) and disturbance to the outlet stream Halfway Brook (NYS Waters Index # D-25, Class B(t). The dam, DEC ID # 148-0837, was breached during storms in 2005.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification of the Title V permit held by the Northeast Solite Corporation located in the Town of Saugerties, Ulster County, New York. The facility utilizes rotary kilns to manufacturer lightweight aggregate used in the building industry.

The subject of this permit modification is for the addition of natural gas to the facility as a fuel source for the rotary kilns. The capacity of the kilns will not change. A decrease in NOx emissions is expected as a result of using natural gas as a fuel. This also results in a revision to the facility NOx RACT (Reasonably Available Control Technology) plan. RACT is determined to be tangential firing of the kilns when using coal as a fuel. There is no technically or economically feasible emission control equipment to reduce NOx emissions from the kilns.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
