Maintenance Guidance for Stormwater Management Practices

The New York State Department of Environmental Conservation (NYS DEC) is making the draft of the Maintenance Guidance for Stormwater Management Practices available for public review and comment.

The purpose of this document is to provide guidance on how to inspect and maintain the stormwater management practices found in the New York State Stormwater Design Manual. Guidance is provided for all levels of skill including homeowners; low to moderately skilled municipal staff; highly trained municipal employees; and design professionals such as professional engineers, landscape architects or other professionals who can revisit design issues associated with chronic or serious maintenance problems.

Proposed Rulemaking to Amend Lake Champlain Drainage Basin Regulations

The purpose of the proposed rulemaking is to amend Part 830 of Title 6 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (6 NYCRR) to upgrade the classifications of certain surface waters in the Lake Champlain drainage basin. These reclassifications are necessary in order to meet federal Clean Water Act goals for water quality.

Public Information Meetings Time and Location

The New York State Department of Environmental Conservation (NYS DEC) will hold public information meetings on October 13, 2016 from 2:00 to 4:00 p.m. and 6:00 to 8:00 p.m. at Town of PlattsburghTown Office Meeting Room, 151 Banker Road, Plattsburgh, NY 12901. The NYS DEC will present an overview of the proposed rulemaking at both meetings. Note that these are information meetings only, and no public comments will be accepted at these meetings.

Public Hearing Time and Location

The NYS DEC will hold a public hearing at 11:00 a.m. on November 2, 2016 at Town of Plattsburgh Town Office Meeting Room, 151 Banker Road, Plattsburgh, NY 12901. The purpose of the public hearing is to accept oral and written comments on the proposed rulemaking.

Public Comment on the Proposed Rulemaking

Public Comment Period

The public comment period commences on September 7, 2016. Written statements may be submitted to Robert Simson, NYS DEC - Division of Water, 625 Broadway, 4th Floor, Albany, NY 12233-3500 or by email to: Part.830Reclass@dec.ny.gov. Written statements must be submitted to the NYS DEC by 5:00 p.m. on November 7, 2016.

Public Hearing

At the public hearing to be held on November 2, 2016, attendees will have an opportunity to make an oral statement and/or file a written statement. It is not necessary to file a written statement or request in order to appear to make a statement at the hearing. Written statements received prior to, during, or after the hearing (before the comment period closes), and oral statements made at the hearing will be given equal consideration.

Public Information Meetings and Public Hearing Facilities/Services

The public hearing and public information meetings are scheduled at a location reasonably accessible to persons with a mobility impairment. Interpreter services will be made available to hearing impaired persons, at no charge, upon advance written request received by the NYS DEC (see contact information below) within a reasonable time prior to the scheduled hearing and information meetings.

Environmental and Regulatory Impact Review

NYS DEC has determined that the proposed revisions will not have a significant adverse environmental impact. The NYS DEC has prepared a Regulatory Impact Statement, a Regulatory Flexibility Analysis for small businesses and local governments, a Rural Area Flexibility Analysis and a statement why a Job Impact Statement is not required, in accordance with the State Administrative Procedures Act.
