This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Construction of a 19-lot single family residential subdivision with associated roads and stormwater infrastructure on a +/- 27.8 acre parcel on the west side of Benedict Road, 0.1 mile south of Round Lake Road. Development of the site will result in impacts to +/- 0.03 acres of DEC regulated Freshwater Wetland R-21 (Class 1) and +/- 0.09 acres of the regulated adjacent area, as well as impacts to federally regulated wetlands. Wetland and adjacent area impacts have been minimized to the maximum extent practical through reconfiguration of the lots by the developer.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Ballston Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:
