Project Description:

The Department has made a tentative determination to approve this application to re-issue a SPDES permit which had been allowed to expire for an existing surface discharge of up to 132,000 gallons per day (gpd) of treated sanitary wastewater from the Wastewater Treatment Facility in the Town of Hyde Park to Unnamed Tributary of Fall Kill, water index number HR-114, Class C.

The Town of Hyde Park has transferred its ownership of the Greenfields Sewer System - Part County Sewer District #8, located at 9 Windmill Road, Hyde Park, to Dutchess County Water and Wastewater Authority (DCWWA).

The draft SPDES permit outlines the upgrades and repairs to the treatment plant, which are to be completed in accordance with the schedule of compliance in the permit. A Water Quality Based Effluent Limit review was conducted which resulted in summer and winter ammonia limits which are protective of water quality for the receiving waters, and more stringent water quality standards for total residual chlorine. Interim technology based effluent limits will be in effect for ammonia and chlorine while upgrades to the disinfection system are completed. In addition, due to the change in classification of a Class D waterbody from a Class C, the standard for pH has been updated to a range of 6.5-8.5. Monthly operation reporting will be required. A draft permit is available for inspection and comment at the regional office.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the Title V permit for the Wheelabrator Westchester LP facility located in the Town of Peekskill, Westchester County, New York.

Wheelabrator Westchester LP is an existing waste to energy facility with three identical municipal solid waste (MSW) combustor. Each combustor is rated at 750 tons per day, equivalent to 325 MMBtu/hr at 5,200 Btu/lb MSW. The facility-wide allowable maximum municipal solid waste is 755,000 tons per year based on Title V Renewal 2 permit modification and Solid Waste Management permit modification tonnage increase. The facility-wide NOx emission is limited to 1066 tons per year (tpy) as established in the Title V renewal 2 modification in order to stay below significant emission increase threshold of 25 tpy.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
