Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 410 gallons per minute of water from on-site groundwater wells for chemical manufacturing. The facility has been in operation since 1939. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

Joint Notice of Availability for Review of Draft Supplemental Environmental Impact Statement (DSEIS) and Draft Title V Air Pollution Control Permit

The Department has made a tentative determination to issue a renewal and modification of the Title V permit to add the Potential to Emit (PTE) from the Parkway Expansion Phase III landfill for a 144.5 acre expansion in the town of Macedon.

The Part 360 Solid Waste Management Facility Permit and natural resource permits for the proposed Phase III expansion were issued in 2008. This Part 360 permit was modified in 2011 to eliminate the vertical expansion and in 2013 to add the intermodal rail facility. This modification is the air permit portion of the Parkway Expansion Phase III expansion (which was deferred in 2008 to allow air modeling closer to the actual construction of the expansion).

The Title V permit currently covers only the existing landfill including the closed landfill, the western expansion, and Parkway Expansion Phase I and II. The facility includes a landfill gas to energy (LFGTE) facility with four 3516 caterpillar engines and four 3520 caterpillar engines along with two enclosed flares. This modification would add the proposed Phase III expansion, and add a new emission source LFEXP for the landfill. This source will produce fugitive emissions, and gas which will be treated by the existing LFGTE facility and enclosed flares.

The expansion does not include an increase in acceptance rate; it will remain the same at 1.4 million tons per year. However, the expansion will add approximately 44.5 million cubic yards of space to the existing 26,969,858 cubic yards, resulting in an increase in landfill gas generation rate of 10,320 cfm, for a total peak generation rate from both the existing and expansion landfills of 13,433 cfm.

The modification includes a review under the Prevention of Significant Deterioration (PSD) and Non-Attainment New Source Review (NANSR) programs for non-methane organic compounds (NMOC), carbon monoxide (CO), oxides of nitrogen (NOx), sulfur dioxide (SO2), and greenhouse gases (GHGs). The applicant demonstrated that flaring the collected landfill gas with an enclosed flare is considered Best Available Control Technology (BACT) and Lowest Achievable Control Technology (LAER). Information regarding the demonstration of the Lowest Achievable Emission Rate (LAER) and Best Available Control Technology (BACT) are available in the regional office and may be reviewed upon request.

The draft permit includes requirements for BACT, LAER, New Source Performance Standards (NSPS) for NMOCs, Maximum Available Control Technology (MACT), Reasonably Available Control Technology (RACT), and Emission Reduction Credits. The applicant will utilize 79.6 tons of NOx emission reduction credits (ERCs) which represents the total required for the 69.2 TPY of project NOx emissions times the offset ratio of 1.15.

The Department coordinated the SEQR process on November 2, 2015 to request Lead Agency. No objection to DEC's intent to serve as the SEQR lead agency was received, and on March 3, 2016 a Positive Declaration was issued by the Department as the SEQR Lead Agency. The Department public noticed a draft scope on March 3, 2016 and did not receive any comments.

The draft Supplemental Environmental Impact Statement (DSEIS), which focuses on the evaluation of air impacts only, is now available for review and comment. The DSEIS includes an evaluation of potential impacts to air quality, and compares the different options for controlling emissions as well as mitigation measures and other issues required by the final scoping document. The DSEIS is available for review at the Town of Macedon Library located at 32 Main St, Macedon, NY 14502; at the NYSDEC Region 8 Office in Avon, at the High Acres Landfill & Recycling Center at 425 Perinton Parkway, Fairport, NY; and by requesting a disk or by downloading from this link: http://www.bartonandloguidice.com/HighAcresSEIS.htm.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
