Project Description:

Broome County IDA proposes to construct a new 650,000 square foot distribution facility at 90 Broome Corporate Parkway north of Hickory Drive. Construction will impact 0.02 acres of state designated freshwater wetland BE-5. Substantial effort to avoid, minimize and mitigate for the wetland impact has been performed. Stormwater runoff during construction will be controlled through use of an acceptable Stormwater Pollution Prevention Plan. The Town of Conklin as lead agency has issued a SEQR Negative Declaration.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Conklin Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant, F S Lopke Contracting, Inc. is proposing to renew and modify its existing sand and gravel mining permit by adding 34.5 new acres of land to the existing 74 acre life-of-mine area, with a 2.5 acre area to be completely avoided, resulting in an 111.0 acre life-of-mine boundary, within 329.15 acres of land owned by the applicant and located on River Drive, northwest of Stanton Hill Road in the Town of Nichols, Tioga County. Applicant's final reclamation objective of the newly proposed 34.5 acres is to create a 25.2 acre open water pond with a 2.5 acre island. The final pond floor elevation will be 732' which is at least 50' below the approximate water table elevation of 786 +/- feet, and the remaining acreage will be graded and seeded with grass. Applicant does not propose any changes in processing or production or to the reclamation objective of the lands currently permitted for mining activity.

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
