Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 405 gallons per minute of water from on-site springs to support hatchery operations. The facility has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

This Department has received a request to issue a State facility permit and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at AMS USA Production Inc.; 5775 Marcy-SUNY Prkwy; Marcy, NY 13403.

The Department has made a tentative determination to approve the application of the State Facility Permit that allows the operations of emission units 1-COMBS and 1-FABOP. Emission unit 1-COMBS includes the operation of several boilers to provide heat and process water to the facility which includes three boilers rated at 54MMBtu/hr on Natural gas, two boilers rated at 54 MMBTU/hr on natural gas with #2 fuel oil allowed only during periods of natural gas curtailment. Emission unit 1-FABOP includes the manufacture of high performance analog semiconductors through the process of photoresisting, wet-dry etching, doping and layering, chemical mechanical planarization, and cleaning operations. The facility has capped out of Title V Permitting requirements by tracking and restricting it's emissions of Carbon Monoxide and Oxides of Nitrogen to below 100 tons per year. The facility has also conducted a review for the control of toxic ambient air contaminants in New York State based on the requirements of 6NYCRR Part 212.

The draft permit with all conditions is available for review in the Region 6 NYSDEC sub-office in Utica, NY. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has received a request to modify a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air Title V Permit, at the facility Arconic, formerly Alcoa Inc. The facility is located at Park Ave E, Massena, NY, in St. Lawrence County.

The Department has made a tentative determination to approve the application of Arconic, which provides for the operation of an ingot extrusion facility. This application is being submitted to address the split of Alcoa Inc. into Arconic and Alcoa USA Corp. This modification of the Title V Permit allows the operations and of emission units A-00001, D-00001, F-00001, P-00001, and W-00001, which includes heat treat furnaces, aluminum burnishing, fugitive emissions, parts washers, and waste water treatment systems.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The Department has made a tentative determination to approve the application of Alcoa USA Corp, which provides for the operation of the Primary and Secondary Aluminum production facilities, formerly owned by Alcoa Inc. This application is being submitted to address the split of Alcoa Inc. into Arconic and Alcoa USA Corp. This new Title V Permit allows the operations of emission units A-00001, A-00003, B-00002, C-00001, C-00002, D-00001, F-00001, P-00001, M-00001, M-00002, S-00001, S-00002, S-00003, S-00004, S-00005, and S-00006. This includes the pre-bake potlines, the pre-bake ring furnace, material handling, natural gas boilers, melter and holder furnaces, fugitive emissions, parts washers, and includes the removal of 4 boilers firing #6 oil.
