Project Description:

The applicant proposes to install a water/sewer line and maintenance road, which will cross a Class 3 wetland (PB-5), to provide service to an existing commercial property. The crushed-stone road (20'W x 8-10" thick) would cross 400' of adjacent area and 30' of wetland. A 4' diameter culvert will maintain water flow through the wetland. The project is located on private vacant land behind Good Guys Convenience on St Rte 22, Plattsburgh.

Project Description:

The Department has prepared a draft permit and made a tentative determination to approve a modification of the existing Air Title V Facility permit for the Finch Paper pulp and paper mill. The modification implements the NOx RACT (Reasonably Available Control Technology for Major Facilities of Oxides of Nitrogen) plan for power boilers which was submitted on April 12, 2016. NOx emissions react with volatile organic compounds in the atmosphere to create ozone which can be a health hazard. This reaction typically happens during warm weather, and the "ozone season" under 6NYCRR Subpart 227-2 is May through September.

Finch Paper's earlier Title V permit had a power boiler emission rate of 0.45 pounds of NOx emissions per million British Thermal Units (lb/mmBtu) based on a previous RACT plan. In accordance with 6NYCRR Part 227-2, the current NOx RACT limit is 0.15 lb/mmBtu. Therefore, New York State Department of Environmental Conservation has received and proposes to approve a new RACT waiver incorporating the following changes:

1. The power boilers will no longer fire oil - they will fire natural gas only (except under natural gas curtailment).
2. The allowable NOx emission rate during the period April 15 through October 15 will be 0.225 lb/mmBtu - half the current limit.
3. During the remainder of the year, they will manage the boiler load to limit the use of their highest NOx-emitting boiler.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The applicant proposes a new 40.3 acre life of mine dimension stone mine on an 87.94 acre parcel owned by the applicant located in the Town of Whitehall off State Rt. 4. The site was previously used for agriculture and has not been previously mined. Reclamation will be restoration to meadowland. Minimal blasting and potential occasional screening and crushing may also be conducted.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
