Project Description:

The applicant proposes to remove two existing dwellings and associated accessory structures and construct a 280 unit assisted living facility having paved parking for 252 vehicles, stormwater drainage, public sewer and water, and other appurtenances. The proposal has the potential to modify some confirmed habitat of the eastern tiger salamander. Since the tiger salamander is listed in NY State as an endangered species, the project requires an Endangered Species Incidental Take permit. The two parcels that make up the project site total 18.23 acres, of which, 9.73 acres of mostly previously disturbed areas will be utilized to construct the proposed facility. The project design includes measures to avoid and minimize impacts to the tiger salamanders from the proposed construction and measures to secure the viability of its habitat in the future. These measures include the conveyance of 8.5 acres of natural and landscaped areas in the northern portion of the site adjacent to the existing off site open space to the Town of Oyster Bay, and the installation of a recharging drainage system to prevent stormwater from the building and pavement from reaching the habitat area. Additionally, a proposed fence conforming to NYSDEC requirements for tiger salamander protection will be installed between the existing open space area and the proposed development. The project site is located at 300-310 Jericho Turnpike, which is located at the northwest corner of Jericho Turnpike and Cedar Swamp Road, Jericho, Town of Oyster Bay, Nassau County Tax Map 17-11-26 & 27.

Project Description:

The Department has prepared a draft permit, and made a tentative determination to approve the application to modify the facility's Air Title V permit. The modification authorizes the replacement of one UTECO Coral 625 Model Press with one Soma Premia 820 1050 1270 1450 - 8EG Press, and the associated increase in throughput which will result in an increase in the facility's Potential to Emit (PTE) volatile organic compounds (VOC) from 34.5 tons per year to 45.28 tons per year.

The facility conducts Flexographic printing operation using one UTECO Coral 625 model 120 press, one Soma Premia 820 1050 1270 1450 - 8EG press, and bag machines. The bag machines are are trivial sources pursuant to 6 NYCRR 201-3.3. The Presses exhaust their fumes to a Catalytic Oxidizer operating under a seasonal variance for solvent destruction.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Department has prepared a draft permit and has made a tentative determination to approve the application to renew the facility's Title IV and Title V Air Permits.

The facility consists of one simple cycle combustion turbine (GE LM6000) which fires only natural gas. The turbine employs a spray intercooling system to optimize power output. The unit is equipped with selective catalytic reduction (SCR) to control emissions of oxides of nitrogen and catalytic oxidation to control emissions of carbon monoxide.
