Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 800 gallons per minute of water from an on-site pond fed by the Erie Canal for golf course irrigation. The facility has an active Canal Corp permit to withdraw up to 500,000 gallons per day from the Erie Canal. The facility has been in operation since 1928. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The Department intends to issue an individual Water Quality Certification for impacts to federally protected waters of the US and associated mitigation of the following project. Applicant proposes to alter the layout of the Route 531/Route 36/Route 31 intersection. The new layout includes impacts to 0.55 acres of Federal wetland and three (3) Class C streams - Salmon Creek and two of its tributaries. The Salmon Creek culvert will be extended by 15 feet and include a natural stream bottom. A culvert in an unnamed tributary is being replaced and another culvert in an unnamed tributary is being lined with centrifugally cast concrete. Project includes construction of headwalls, wingwalls, and footings.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

The applicant proposes the replacement of 700 linear feet of aging 8 inch diameter forcemain for wastewater under the Keuka Canal outlet in the Village of Penn Yan and the Town of Jerusalem. The 350 foot section under the canal is to be done via horizontal directional drilling, and the remaining sections are to be open trenched, causing a temporary disturbance of 1500 square feet to the regulated adjacent area of NYS Freshwater wetland PY-1.
