In addition to the excavation of accumulated sediment, the stream will be widened a maximum of 4 feet. All excavated material will be regraded and seeded onsite so as to not re-enter the stream.

The applicant proposes disturbances to an unnamed tributary of the Shawangunk Kill (NYS Water Index #: H-139-13-19-27, Class B) in association with work to repair and structurally improve the Lake Altamont Dam. The proposed work will require Article 15, Dam Safety and Stream Disturbance, Permits from the Department. The proposed work includes the following: spillway repair work; embankment improvements to comply with regulatory standards; improvements to the drain pipe and associated downstream swale to decrease the potential for erosion; and installation of rip rap for erosion control along the dam and at the location where the spillway connects to the stream.

Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a renewal of the Title V permit held by the Sullivan County Landfill. The Facility is a Municipal Sold Waste landfill complex located on 260 acres of County owned land situated in the Village of Monticello, Sullivan County. The complex contains three different landfill areas known as the Old Village landfill, the Old County landfill and Phase I cells 1 through 6. Both the Old Village and Old County landfills received waste between 1963 through 1993. The Phase I landfill received waste through 2009. All three landfills are capped with a total waste in place volume of some 3 million megagrams. Landfill gas generated is collected and controlled by two centrally located open flares. The subject of this Title V permit Renewal 2 relates to the proper operation of the existing landfill gas collection and control system servicing the closed and capped Sullivan County Landfill.

The facility commenced construction, reconstruction or modification or began accepting waste on or after May 30, 1991 and is subject to Federal New Source Performance Standard 40 CFR Part 60 Subpart WWW-Standards of Performance for Municipal Solid Waste Landfills as well as 40 CFR Part 63 Subpart AAAA - National Emission Standards for Hazardous Air pollutants for Source Categories. The facility is subject to Title V permitting since the design capacity is greater than 2.5 million cubic meters and is a major source for sulfur dioxide and carbon monoxide emissions.

The gas collection system installation and operation is subject to the monitoring, recordkeeping and specification requirements of 40 CFR Part 60 Subpart WWW. This includes monthly wellhead parameter monitoring, quarterly and annual surface methane monitoring and the operation of two open flares as control devices.

The Standard Industrial Classification (SIC) for this facility is 4953 - Refuse Systems.


In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

Applicant proposes to disturb the bed and banks of approximately 350 linear feet of the Bushkill (DEC Water Index No. H-171-P848-5-1) by removal of fill and re-grading side-cast stream materials which were placed at the channel margins during post-Irene emergency stream intervention work. The purpose of the fill removal and regrading is creation of a suitable stream channel dimensions relative to the watershead area. Remaining side cast material will be graded to stable slopes and have various bioengineering techniques installed utilizing Catskill Mountain native riparian vegetation. Invasive plant species in the project area will be removed. Stormflow capacity of the channel will be increased by removing side cast material and creation of floodplain benches along the project area.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 900 gallons per minute of water from on-site wells for potable water supply. The facility has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
