Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 750 gallons per minute of water from an on-site pond and well for golf course irrigation. The facility has been in operation since 1930. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The applicant has applied for a renewal of the Air State Facility permit for the above-referenced facility, which includes printer equipment manufacturing and assembly operations, and related research and development operations. The site is located in the Town of Gates, Monroe County and is part of the Rochester Technology Park, which is bordered by Manitou Road on the west and Elmgrove Road on the east. In addition to renewing the permit the following updates will be made: set the permit term to 10 years; incorporate changes previously approved pursuant to 6 NYCRR 201-5.4; implement revised volatile organic compound (VOC) emissions cap for Process C02; incorporate surface coating limits & requirements per revised 6 NYCRR Part 228; incorporate general process emission source limits & requirements per revised 6 NYCRR Part 212; and correct reporting requirements specified in various permit conditions.

The permit, as drafted, contains conditions requiring that the facility-wide emissions of volatile organic compounds (VOCs), total hazardous air pollutants (HAPs), and any individual HAP, will not exceed 49.9 tons per year (TPY), 24.9 TPY, and 9.9 TPY, respectively. These facility emission caps will ensure that the emission thresholds for a major source of air contamination are not exceeded and the Kodak Manitou facility will not require a Title V Air Facility Permit.

Emission rates for VOCs have been established for coatings used in the metal parts coating process (Process # CO2) that contain greater than 2.3 lbs VOC/regulated gallon of coating. In order to maintain compliance with 6 NYCRR Part 228-1.5(e) a RACT (Reasonably Available Control Technology) limit has been established requiring annual emissions of VOC from this process to be limited to 9.9 TPY on a monthly basis from material usage and production records, and incorporated into a twelve month rolling total of no more than 24.9 TPY. This RACT limit is based on an October 2015 re-evaluation of the limits originally permitted. The RACT determination will be re-evaluated every five years or prior to any changes that could significantly impact the RACT evaluation.

Project Description:

The applicant is proposing the construction of a 123 room hotel on a 3.54 acre parcel. The project would result in impacts to 0.8 acres of regulated NYS freshwater wetland (GR-15) and 2.62 acres of impact to the corresponding wetland adjacent area. The Town of Greece, acting as the State Environmental Quality Review (SEQR) lead agency, has determined the proposed project is consistent with the previously issued Final Generic Environmental Impact Statement and the accompanying SEQR Findings. Additionally, the wetland impacts which would result from the proposed project have been previously mitigated so no further mitigation for the proposed wetland impacts is being required. A stormwater pollution prevention plan has been developed and approved by the Town of Greece, an MS4 community.
