Negative Declaration

New York County (Manhattan) - The Trust for Cultural Resources of the City of New York, as lead agency, has determined that the proposed Expansion Project will not have a significant adverse environmental impact. The "Expansion Project" consists of (A) planning, construction, and equipping in furtherance of the development and integration of a condominium unit (53 MoMA Project) that will be owned by the Museum in a mixed-use facility (53 Project) currently under construction that will contain multiple condominium units at the street address of 53 West 53rd Street, New York, New York, into the Museum's current galleries located in the 2009 Facility on the second (a double-height floor), fourth and fifth floors; (B) planning, construction, and equipping in furtherance of the development and integration of additional new gallery, public, educational, and back-office spaces at the site adjacent to the 2009 Facility and located at 45 West 53rd Street, New York, New York 10019 (45 Project) (the new construction and integration of the 53 MoMA Project and the 45 Project into the 2009 Facility constituting the Expanded Main Facility); (C) the planning and design of the Expanded Main Facility, including the integration of the 53 MoMA Project and the 45 Project with the 2009 Facility; and (D) construction, renovation, and equipping to otherwise integrate the 53 MoMA Project and the 45 Project with the 2009 Facility to create the Expanded Main Facility in order to improve circulation, enhance the experience of all visitors to the Museum and provide other benefits.

The project is located at 53 West 53rd Street and 45 West 53rd Street in New York City, NY.

Notice of Acceptance of Final EIS

Kings County (Brooklyn) - The New York State Urban Development Corporation d/b/a Empire State Development (ESD), as lead agency, has accepted a Final Environmental Impact Statement on the proposed Fountain Avenue Land Use Improvement and Residential Project. A hard copy of the Final EIS is available at the following locations: ESD Offices, 633 Third Avenue, New York, NY 10017; the Spring Creek Library, 12143 Flatlands Avenue at New Jersey Avenue, Brooklyn and on line at: http://esd.ny.gov/Subsidiaries_Projects.html.

The action involves the design, development, construction and operation of an approximately 972,787 square feet of residential space totaling approximately 1,169 units of housing for households earning up to 60% area median income (AMI) which includes approximately: 200 senior units as well as supportive housing units for people with intellectual and developmental disabilities; 105,460 square feet of retail, commercial or community facility space; and 170,594 square feet of parking. The project is located at the former Brooklyn Developmental Center with an address of 888 Fountain Avenue, in the Spring Creek neighborhood of the East New York section of Brooklyn.

Parcel A contains a total of 2 acres and is located on the southeast corner of Seaview Avenue and Erskine Street. Parcel B contains a total of 4.7 acres and is located along the south block-front of Vandalia Avenue between Erskine Street and Fountain Avenue. The Project will include a new privately-owned publicly accessible open space called Schroeders Walk which will be a pedestrianized extension of Schroeders Avenue through the site.
