Pursuant to the Environmental Conservation Law subdivision 13-0309 (12), the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

NYS DEC has filed a Notice of Adoption to amend 6 NYCRR Part 43, Subparts 43-2 and 43-3, pertaining to harvest management measures and vessel replacement in the Atlantic Ocean surfclam fishery. This notice will be published in issue 30 of the State Register on July 27, 2016.

New York State Drinking Water State Revolving Fund Intended Use Plan

Final Amendment No. 5 to the Drinking Water State Revolving Fund (DWSRF) Federal Fiscal Year (FFY) 2016 Intended Use Plan

FFY 2016 DWSRF Intended Use Plan Amendments:

Draft Amendment No. 5 to the Drinking Water State Revolving Fund Intended Use Plan (IUP) issued October 1, 2015 was published in the June 15, 2016 issue of the Environmental Notice Bulletin. The comment period for Draft Amendment No. 5 closed on June 29, 2016 and the New York State Department of Health received no public comments pertaining to the Amendment. Therefore, as of June 30, 2016 the Amendment as shown below was final:

DWSRF#18161 Dering Harbor (V), Suffolk County - The project cost as listed in the DWSRF Intended Use Plan (IUP) is increased by $150,000. This increase is due to revised project cost estimates thereby reflecting the potential additional funds that may be required for the short term financing of the project.

DWSRF#18160 NYCMWFA- New York City - The project cost as listed in the DWSRF Intended Use Plan (IUP) is increased by $10,750,000. The applicant's original project listing form did not include the total estimated eligible project costs. This amendment provides for those costs thereby reflecting the potential additional funds that may be required for the short term financing of the project.

The New York State Department of Health (NYS DOH) has determined that the amendments are necessary, reasonable, and in the interest of protecting public health. The amendments will not adversely affect any project on the IUP Project Annual List above the subsidized funding line. Except as noted above, there are no other changes to the IUP as a result of this Amendment No. 5 of the FFY 2016 IUP.
