Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,042 gallons per minute of water from the West Branch of Fish Creek for non-contact cooling purposes. The facility has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

Project Description:

The Department has received a request for a permit modification to operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a State Facility Permit Modification, for the facility located at Curran Renewable Energy LLC, City of Massena in St Lawrence County, New York. The exact location is 20 Commerce Drive in Massena, NY. This facility is engaged in the manufacture of wood fuel pellets. The Standard Industrial Classification representative of this facility is 2499 (Wood Products). With respect to air pollution regulation, the activities of concern at Curran Renewable Energy are the by-products of wood combustion, raw wood particulate emissions and VOC/HAP emissions that elute from the pressure-forming of wood into pellets.

This Permit modification will add a new combustion unit (wood-fired furnace) to the permit. Various Air Regulations and caps have been added to accompany the furnace.

The facility has imposed limitations on manufacturing processes that have been designed to control carbon monoxide emission at levels that are below the major source threshold. Various manufacturing processes have been required to undergo repetitive stack re-testing at ten year intervals.

The tests will be for carbon monoxide, VOC, HAP and for particulates. This testing regime will verify that this facility's emissions continue to elute within current Regulatory Standards.

The draft permit with all conditions is available for review in the Region 6 NYSDEC sub-office in Utica, NY.
