Project Description:

The applicant proposes the construction of 5 warehouses, parking area, utilities and stormwater facilities as part of Phase 2 at the Scottsville Road Genesee Valley Regional Market facility. As proposed, there will be temporary impacts of 1.12 acres to the regulated wetland (CI-6) adjacent area associated with the installation of silt fence, sediment traps and rip rap stabilization. Permanent impacts of the regulated wetland adjacent area, associated with the construction of the stormwater management facilities would total 0.25 acres. A stormwater pollution prevention plan has been prepared.

State Environmental Quality Review (SEQR) Determination:

SEQR Lead Agency: Chili Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 800 gallons per minute of water from on-site springs and Blue Pond for fish hatchery operations. The facility has been in operation since 1956. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

Applicant proposes to install a private force main which includes approximately 850 linear feet of 6-inch sanitary sewer and 3,958 linear feet of 4-inch PVC pipe, as well as a private duplex sanitary pump stations, as part of constructing a new sanitary sewer to service a new manufacturing/athletic complex. Approximately 1,070 feet of the force main will be installed via directional drill within the regulated State Freshwater Wetland ON-47 (Class 2) and its 100-foot adjacent area. Erosion and sediment controls will be used to minimize potential impacts to both wetlands and there is a Frac-Out Contingency Plan. Pipe will be installed at a minimum of 5 feet under the bed of a tributary to Red Creek (Class C).
