Project Description:

The applicant proposes a 9-acre expansion of an existing sand and gravel mine, increasing the total life of mine area from 5-acres to approximately 14-acres on an approximate 57 acre property. In addition to current mining operations, the proposed modification would add processing of materials as an authorized activity by the addition of new diesel powered crushing and dry screening equipment as NYS emissions sources (Air Facility Registration Certificate #3-3338-00014/00003). A total of 188,000 cubic yards of material will be removed from the expansion area in five phases. Topsoil will be stripped and stockpiled onsite as perimeter screening berms for later use in reclamation. Reclamation will proceed concurrently with mining operations and proposed final reclamation will return mined areas to agricultural use. The Kowalczik mine is located on the southeastern side of Hoslers Road, approximately 2000 feet south of Hortons Road, in the Town of Minisink, Orange County.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
