Project Description:

Dominion Transmission Inc., filed an application for a Certificate of Public Convenience and Necessity (Certificate) with the Federal Regulatory Commission (FERC) on June 2, 2014 to construct and operate the New Market Project which involves the expansion of its existing pipeline systems located in New York. The New Market Project includes the construction of two new compressor stations (Horseheads Compressor Station and Sheds Compressor Station) and the modification of an existing compressor station (Brookman Corners Compressor Station). The new compressor stations and the modification of the existing compressor station require the issuance of Air State Facility permits as described below.

The project also involves modifications of two existing compressor stations (Borger Compressor Station and Utica Compressor Station) and a metering station (West Schenectady Meter Station). The modifications at these facilities include adding gas coolers and other upgrades that do not require approval from New York State Department of Environmental Conservation (NYS DEC).

The purpose of the proposed project is to provide an additional 112,000 dekatherms per day (Dth/d) of firm pipeline capacity to deliver natural gas to customers along the Dominion Pipeline in New York State.

New Horseheads Compressor Station

NYS DEC has prepared a draft permit and has made a tentative determination to issue an Air State Facility Permit for Dominion's proposed Horseheads Compressor Station located in the Town of Veteran, Chemung County, NY. As proposed, the Horseheads Compressor Station will consist of one natural gas fired turbine (11,010 hp) and associated equipment that are considered exempt sources under 6 NYCRR Part 201 (Air Permits and Registrations) (hot water boiler, hot water heater, furnace and three micro-turbines).

New Sheds Compressor Station

NYS DEC has prepared a draft permit and has made a tentative determination to issue a new Air State Facility Permit for Dominion's proposed Sheds Compressor Station located in the Town of Georgetown, Madison County, NY. As proposed, the Sheds Compressor Station will include the installation of one natural gas fired turbine (10,880 hp) and associated equipment that are considered exempt sources under New York State air regulations (hot water boiler, hot water heater, furnace and four micro-turbines).

Modification to the Brookman Corners Compressor Station

NYS DEC has prepared a draft permit and has made a tentative determination to issue a modified Air State Facility Permit for Dominion's Brookman Corners Compressor Station located in the Town of Minden, Montgomery County. The modification to the existing station includes the addition of a natural gas fired turbine and two reciprocating engines (11,133 hp total) and the installation of additional coolers.

Stream and Wetland Impacts - Water Quality Certificate

The construction of the new Horseheads Compressor Station will require 190 linear feet of temporary stream disturbance from the installation of a pipeline to connect the new station with the existing transmission pipelines. The stream is an intermittent, unnamed tributary of Bulkley Brook and is not mapped under New York State water classification regulations.

The original application for the project included the temporary disturbance of .034 acres of federal wetlands associated with the creation of a construction equipment crossing during construction of the expansion at the Brookman Corners Compressor Station. The construction activities at this location have been revised to eliminate the need to impact federal wetlands.

These areas to be disturbed meet the United States Army Corps of Engineers (US ACOE) threshold for wetlands and requires federal approval. The proposed areas of disturbance qualify for coverage under the USACOE's Nationwide Water Quality Certification program. In accordance with Section 401 of the Clean Water Act, NYS DEC must certify that the proposed activities meet New York State water quality standards and issue a Water Quality Certificate. NYS DEC has made a determination that the proposed activity at the Horseheads Compressor Station qualifies for coverage under the statewide blanket Section 401 Water Quality Certification for the USACOE's Nationwide Water Quality Certification program.

National Environmental Policy Act (NEPA) Determination

FERC is the lead agency for the environmental review of interstate natural gas pipelines. On October 20, 2015, FERC staff prepared an Environmental Assessment (EA) for the New Market Project proposed in Docket No. CP14-497-000, in accordance with the requirements of NEPA. NYS DEC relies upon the federal NEPA environmental impact review process conducted by FERC to complete its review of the permit applications submitted by applicants to NYS DEC and to ultimately make a determination whether to issue its authorizations.

National Historic Preservation Act (NHPA)

These applications are being reviewed in accordance with Section 106 of the NHPA. The applications are not subject to the New York State Historic Preservation Act.

Coastal Zone Consistency

The project is not located within a coastal area and not subject to the Coastal Zone Consistency Program.

NYS DEC Policy 29, Environmental Justice and Permitting (CP-29)

The Air State Facility permit applications for the two compressor stations and the modification to the existing compressor station are subject to CP-29; however, review in accordance with methodology at Section V.B of the policy has resulted in a determination that no potential adverse environmental impacts related to the proposed action are likely to affect a potential environmental justice areas.

Statutory and Regulatory Provisions

The above referenced applications were filed and reviewed pursuant to Environmental Conservation Law (ECL) Article 3, Title 3 (General Functions, Powers, Duties and Jurisdiction), and Article 70 (Uniform Procedures Act or UPA); and pursuant to Title 6 of Official Compilation of Codes, Rules and Regulations of the State of New York (6 NYCRR) Part 621- Uniform Procedures.

The relevant provisions for the Water Quality Certificate are found at: Section 401 of the federal Clean Water Act (CWA) (33 USCA §1341) and the regulations promulgated at 6 NYCRR §608.9 and 6 NYCRR Parts 700 - 706 and 750.

For the compressor station projects the relevant statutory provisions are found at: ECL Article 19 (Air Pollution Control).

In addition to these permits being considered under Uniform Procedures Act (UPA), the project is required to demonstrate the ability to obtain coverage under the State

Pollutant Discharge Elimination System Stormwater General Permit for Construction Activities (GP-0-10-001) prior to conducting any construction activities that disturb greater than one acre.
