Project Description:

The project sponsor proposes improvements to the 5015 Route 17M Johnston's Toyota facility within 0.769 acres of the New York State regulated 100 foot adjacent area of freshwater wetland MD-28, Class III. Such improvements include the construction of stormwater management infrastructure (e.g. detention pond) and the reconstruction of an existing on-site Subsurface Sewer Discharge System (SSDS).

In addition, the reconstructed SSDS will be required to gain coverage under a State Pollutant Discharge Elimination System (SPDES) Permit to discharge of 1,315 gallons per day of treated sanitary sewage to groundwater.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

Applicant is proposing to dredge approximately 1,839 cubic yards of accumulated sediment from an unnamed pond which flows into the Wallkill River (NYS water index # H-139-13, Class B). Dredged material will be deposited onsite at an upland location and regraded and stabilized. The pond is located entirely within the applicant's property located approximately 400 feet east of Wallkill River, Town of Shawangunk. The applicant is also proposing repairs to the existing dam to repair and mitigate erosion under the spillway, and to repair the failing concrete spillway. Appropriate erosion and sediment controls and water diversion methods are proposed to isolate the work area from flowing water to eliminate downstream turbidity.

Project Description:

The applicant is proposing to create a 1.17 acre clay-lined pond via excavation and the construction of a 14.6-feet-tall, 143-feet-long earthen dam. The excavated materials will be used on-site for the construction of the dam, with the excess materials being used to level/grade a portion of the parcel to create a playfield area. The pond is being created for enhanced ecoscaping and recreation within the combined properties of the applicant, and will require an Article 15, Dam Safety, Permit from the Department.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
