Project Description:

The Department has received and made a tentative determination to approve an application to dredge approximately 4,000 cubic feet of silt and sediment from the drainage canal adjacent to the Lakewood Rod and Gun Club. The material has been sampled and determined to be suitable for re-use. Some of the material will be placed behind existing sheet pile on site and the remainder will be placed on a vacant lot owned by the applicant across the street from the Rod & Gun Club. The material will be allowed to drain and then will be spread and seeded.

As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to stabilize 500 linear feet of eroding stream bank by installing a stone toe, sloped rock rip-rap, single stone bendway weirs, and two engineered rock riffles for grade stabilization. Upper slope areas will be stabilized with willow live stakes and seeded with a native seed mix. The project site is located upstream (west) of the County Road 33 bridge over Prendergast Creek, at the facility address above.

The Department has prepared a draft permit (SPDES #NY 0275891) and made a tentative determination to approve an application for the discharge of up to 3,200 gallons per day of treated wastewater to an unnamed tributary of French Creek from a grit chamber and oil/water separator system. The discharge is from a highway vehicle maintenance facility.

As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

Project Description:

The New York State Department of Environmental Conservation (DEC) intends to renew the Part 373 Hazardous Waste Management Permit for CECOS International, Inc. (CECOS) for post-closure maintenance of closed hazardous waste units and continued implementation of the final corrective action remedies for site-wide soil and groundwater contamination at its 5600 Niagara Falls Boulevard facility. This renewal would continue the mechanism for the perpetual care of closed hazardous waste units and corrective action systems. Commercial hazardous waste operations are no longer conducted at the facility. The majority of the facility is located in the Town of Niagara with the remainder in the City of Niagara Falls. The facility operates under the state 6 NYCRR Part 373 hazardous waste management permit issued on November 4, 2009. The permit expired on November 3, 2014. CECOS submitted the renewal application as required in 6 NYCRR 373-1.8 on May 7, 2014. Under the provisions of the State Administrative Procedures Act Section 401(2), the current permit is extended until the Department makes a final decision on the renewal application submitted by CECOS.

A mailing list will be maintained for this facility. The public can submit a written request to the contact person to be put on the mailing list.

In lieu of, or in addition to, the submission of comments as stated above, any interested person may request a Public Hearing. Any request for a public hearing must be made in writing, stating the nature of the issues proposed to be raised in the hearing and submitted to the contact person by the comment deadline.
