Project Description:

The Department has received and made a tentative determination to approve an application to modify the reclamation objective of the Brest Gravel Pit to include a Construction & Demolition (C&D) Debris Processing Facility within the current Life of Mine boundary. The C&D Facility has received a Solid Waste Management Registration and will receive unadulterated wood products as well as uncontaminated concrete, masonry products, steel and asphalt millings. The remainder of the reclamation objective remains unchanged: 13.87 acres of agricultural land and approximately 11.18 acres of combined grass buffers and pond areas. The wood will be processed in a tub grinder and the concrete will be processed with a portable crusher. Concrete crushing is expected to occur only twice per year for a period of 7 to 10 days each time.

As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance.

Project Description:

The Village of Silver Creek proposes to stabilize a 325 linear foot section of eroding stream bank along Walnut Creek by installing large limestone rock rip-rap stacked and tiered up the slope. Bendway weirs will also be installed along the tow of the slope. The rock rip-rap will be pinned in place using 1.5'' diameter, 6' long steel rods to ensure stability. Willow live stakes will be installed at the top of bank, with the remaining portion planted with native buffer plantings. The project site is located approximately 50 feet upstream (south) of the Route 5 Bridge over Walnut Creek at the facility address above.

The Department has made a tentative determination to approve an application for the rehabilitation of an existing shoreline trail on Unity Island in the City of Buffalo from Broderick Park to the CN International Railroad Bridge over Black Rock Canal. The project will include trail surface restoration, replacement of falling timber curb, installation of lighting and signs, repairs to the Buffalo Sewer Authority Combined Sewer Outfall structure and installation of protective riprap and clearing of invasive plant species. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 4,750 gallons per minute of water from on-site irrigation ponds, a NYSDEC Class II wetland called the "Sinking Ponds", and from groundwater for golf course irrigation. The facility has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
