Notice of Emergency/Proposed Rulemaking

Addition of a New Section 190.35 to 6 NYCRR

Pursuant to Environmental Conservation Law, Sections 1-0101(3)(b), 3-0301(1)(b), 3-0301(1)(d), 3-0301(2)(m), 9-0105(1) and 9-0105(3), the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

To protect public health, safety, general welfare and natural resources on the Peekamoose Valley Riparian Corridor in the Town of Denning, Ulster County, New York.

The New York State Department of Environmental Conservation (NYS DEC) has received a Brownfield Cleanup Program (BCP) application from Fondak Enterprises, LLC for a site known as the Glenwood Container Site, site ID #C360154. This site is located in the City of Yonkers, within the County of Westchester, and is located at 72 Alexander Street. Comments regarding this application must be submitted no later than July 8, 2016. Negative Declaration

Ulster County - The City of Kingston Planning Board, as lead agency, has determined that the proposed Smorgasburg Upstate will not have a significant adverse environmental impact. The action involves the establishment of a seasonal outdoor food and flea market. The project site is 20.6 acres of a 76.7 acre parcel. The plan includes renovations to existing structures and construction of site improvements including parking areas, walkways, fighting, bathrooms, stormwater management, landscaping and utilities. The project is located at 200 North Street in the City of Kingston, New York.
