Project Description:

The New York State Department of Environmental Conservation (DEC) intends to renew the Part 373 Hazardous Waste Management Permit for CECOS International, Inc. (CECOS) for post-closure maintenance of closed hazardous waste units and continued implementation of the final corrective action remedies for site-wide soil and groundwater contamination at its 5600 Niagara Falls Boulevard facility. This renewal would continue the mechanism for the perpetual care of closed hazardous waste units and corrective action systems. Commercial hazardous waste operations are no longer conducted at the facility. The majority of the facility is located in the Town of Niagara with the remainder in the City of Niagara Falls. The facility operates under the state 6 NYCRR Part 373 hazardous waste management permit issued on November 4, 2009. The permit expired on November 3, 2014. CECOS submitted the renewal application as required in 6 NYCRR 373-1.8 on May 7, 2014. Under the provisions of the State Administrative Procedures Act Section 401(2), the current permit is extended until the Department makes a final decision on the renewal application submitted by CECOS.

Interested persons with reasonable concerns about the draft permit can raise all reasonable ascertainable issues and submit, in writing, all available arguments and factual grounds supporting their position to the Contact Person below. A mailing list will be maintained for this facility. The public can submit a written request to the contact person to be put on the mailing list.

In lieu of, or in addition to, the submission of comments as stated above, any interested person may request a Public Hearing. Any request for a public hearing must be made in writing, stating the nature of the issues proposed to be raised in the hearing and submitted to the contact person by the comment deadline.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,000 gallons per minute of water from Tonawanda Creek for golf course irrigation. The golf course has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
