Project Description:

The Town of East Fishkill proposes to modify their consolidated water withdrawal permit for the Town of East Fishkill Water Supply (WWA No. 11,399) in order to develop and use three new water supply wells, identified as Fishkill Plains, aka Dogwood Knolls, Well No. 3 (350 gpm), Cannon Property Well No. 1 (440 gpm), and Cannon Property Well No. 2 (435 gpm); and to reflect the extension of the Town's water supply system into new water service areas [e.g. Hopewell Hamlet II Service Area, Hopewell Glen Service Area (Phase I), Hopewell Glen Service Area (Phase II), Cannon Property, Lake Walton Water District and Hopewell Precision Super Fund Site]. In addition, in order to the develop and construct the Cannon Property Well Field located within the Hopewell Hamlet, the Town of East Fishkill is required to obtain a Freshwater Wetland Permit, pursuant to 6 NYCRR Part 663. The wells, access road, and associated water lines will be located within Freshwater Wetland HJ-75 (Class II). In order to mitigate unavoidable impacts to Freshwater Wetland HJ-75, the Department is requiring the Town of East Fishkill to cause the removal of approximately 7500 square feet of historic fill from the wetland, and the inclusion of approximately 22 acres of the wetland within a Conservation Easement Area to prevent further encroachment of the state regulated wetland.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: East Fishkill Town Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

The Department has made a tentative determination to reissue expired SPDES NY0149021 permit for discharge of a maximum of 37,800 gallons per day of treated sanitary wastewater to groundwater. The permit expired 05/17/12. No changes to the facility are proposed. Village Park Apartments is an existing facility located on North Avenue, 500 feet south of Park Drive in Pleasant Valley.

The permittee will be required to maintain records to verify compliance with the SPDES permit conditions and discharge limits.

Section 401 - Clean Water Act Water Quality Certification

Project Description:

Applicant is proposing to conduct remedial activities associated with a former manufactured gas plant in the City of Kingston, immediately adjacent to the Rondout Creek. Remediation is being completed through the NYS DEC Brownfield Cleanup Program (BCP # C3-56017). Remedial activities would be conducted on land and within the Rondout Creek. Primary components of the remediation consist of the following: 1. Replacement of an existing deteriorating bulkhead measuring approximately 440 feet. 2. Dredging of approximately 20,000 cubic yards of contaminated sediment from an area measuring approximately 1.4 acres within the Rondout to depths of 23 feet. 3. Dredging an area of approximately 0.15 acres within the Rondout Creek to remove the top 2 feet of contaminated sediment.

All work will be identified in a DEC approved Remedial Action Work Plan (RAWP).
