The applicant proposes to excavate the width of an unnamed stream on the north and south banks to allow for installation of 2' X 2' X 6' concrete retaining blocks to both banks for approximately 620 feet at the applicant's property also proposed is the removal of a steel culvert pipe, earthen bridge and driveway which will be replaced with a 3 sided concrete bridge. A 130 foot concrete block placement is also proposed on the unnamed stream that runs north south on the applicant's property.

Project Description:

Lindsey Aggregates, Inc. proposes to operate a new sand and gravel mine along the east side of Red Schoolhouse Road in the Town of Palermo. The proposed life of mine will be 15.2 acres within a 200.2 acre parcel of property. Unconsolidated sand and gravel will be extracted with a front end loader or hydraulic excavator. Mining will remain at least two feet above the seasonal high water table. Processing will be limited to the use of a screener which will remain a minimum of 500 feet from nearby residences to prevent any noise disturbance. Sediment and erosion control berms will be used along the perimeter of the mine to prevent sediment laden surface water from discharging outside of the life of mine. The project site is located along the eastern side of Red Schoolhouse Road, 4,500 feet north of the intersection with Clifford Road in the Town of Palermo.

Article 19 Air Title V Facility

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V renewal to Novelis for its operations in Oswego, NY. Novelis Corporation is a secondary aluminum production facility that produces rolled aluminum sheets from scrap aluminum and purchased ingots. Raw materials include purchased (customer) scrap; in-house scrap; used beverage containers (UBCs); sows (blocks of aluminum, such as from a primary aluminum smelter); fluxing agents, hardeners and miscellaneous additives. Processes include mechanical processing of scraps (bale breaking, dirt separation, ferrous separation, shredding), delacquering of UBCs in a rotary kiln, melting, alloying, casting, annealing, rolling and coating.

The operations at this facility are subject to the EPA's National Emission Standard for Hazardous Air Pollutants (NESHAPS) for secondary aluminum processes. The facility also operates numerous gas-fired combustion devices that are subject to the EPA's industrial boiler and process heater NESHAPS. Also, the facility is subject to emission caps that keep the various projects below new source review project thresholds.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
