Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for re-issuance of an expired State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, for the discharge of 1,890 gallons per day of treated sanitary wastewater to an unnamed tributary of Swarte Kill (Water Index No. H-139-13-2-5, Class D). An existing waste water treatment system currently services the Rousner Lane Community Residence. Based on the flow and type of treatment, the facility is considered a non-significant Private, Commercial or Institutional (PCI) facility, Discharge Class 02 and a monthly "Wastewater Facility Operation Report" is not required, but an annual report must be submitted to the Regional Water Engineer and to the Ulster County Department of Health.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at DEC Region 3 headquarters in New Paltz. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. Substantive comments on these permits or requests for a hearing or both must be submitted in writing to the contact person listed below.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,000 gallons per minute of water from an on-site pond and wells for golf course irrigation. The facility has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant proposes disturbance to NYS Freshwater Wetland K-16, Class 2, for the dredging of approximately 2,600 cy of sediment, consisting of 1,000 cy of silt deposits and 1,600 cy of pond bottom material. The proposed methodology for dredging includes the use of mechanical and suction harvest methods, and geo-tubes for dewatering before use and transport. Two (2) pond forebays will be constructed to provide long-term pre-treatment of tributary flows. Area of disturbance includes 0.98 acres of wetland, including the pond surface, and 0.425 acres of the 100 foot adjacent area.
