Pursuant to Environmental Conservation Law, section 03-0301 and section 9-1710 the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

Addition of new Part 576 to 6 NYCRR Aquatic Invasive Species Spread Prevention

The final rulemaking for the Aquatic Invasive Species (AIS) Spread Prevention regulations requires that "reasonable precautions" are taken prior to placing a watercraft or floating dock into public waterbodies to prevent the spread of AIS. A 45 day public comment period was held from December 16, 2015 to February 1, 2016 on the proposed regulations. A total of 22 comment letters were received in which 134 issues were raised.

In response to the comments received, staff made the following nonsubstantive changes to the Express Terms: Minor text change to Purpose, scope and applicability section 576.1 subdivisions (b) and (c); Minor change to Prohibitions section 576.3, subdivision (c), paragraph (2), subparagraphs (i-iv).

Notice of Availability of the Draft Implementation Plan for Pathogen Impaired Waters in Part IX.C of the SPDES General Permit for Stormwater Discharges from Municipal Separate Storm Sewer Systems

The New York State Department of Environmental Conservation (NYS DEC) has drafted the "Implementation Plan for Pathogen Impaired Waters in Part IX.C of the SPDES General Permit for Stormwater Discharges from Municipal Separate Storm Sewer Systems". The Draft Implementation plan explains the methodology used to model the predicted individual MS4 pathogen load contribution(s) to the waters listed in Part IX.C, it identifies the appropriate pollutant load reductions required of MS4s above the allowable pollutant load and it defines further actions necessary to achieve the pollutant load reductions and compliance with the applicable TMDL. Written statements or comments on the Draft Implementation Plan or the supporting documents and tools will be accepted by fax or mail until close of business on June 24, 2016 or 30 days after publication of this notice.
