Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,530 gallons per minute of water from on-site wells for golf course irrigation. The facility has been in operation in its current configuration since 1935. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

Applicant Savona Gravel, LLC is proposing a new 20.2 acre sand and gravel mine on the north side of SR 415, just west of Smith Run Creek, approximately 3.1 miles north of the intersection with State Route 226. Excavation of minerals would occur using a front end loader and excavator. The proposed mining plan includes processing aggregate on-site using a portable screener and crusher. The proposed depth of excavation is about 45 feet and no mining below the water table is proposed. A Stormwater Pollution Prevention Plan (SWPPP) has been prepared to control runoff. In additon, a 15 high earth berm is proposed to mitigate the potential for increase noise levels. The proposed hours of operation are 6:30 a.m. to 4:30 p.m. Monday through Friday and 6:30 a.m. to 12:00 p.m. The facility would be closed on Sundays and major holidays. Under the proposed reclamation plan, the site would be reclaimed to open fields with the finished mining faces graded to a slope no steeper than 1:1.5 (vertical to horizontal), covered with topsoil, seeded and mulched.

The Village of Newark proposes to operate a new compost facility at the existing Newark Wastewater Treatment Plant located at 321 Murray Street, in the Village of Newark. The facility will treat 588 tons of dewatered sludge solids per year, to produce 880 dry tons of compost within a recently constructed building. The compost will be made available to the Village of Newark residents and other Village departments. The Department of Environmental Conservation has determined that the project, as represented in the application, meets the Part 360 requirements. As a tentative determination on the Solid Waste Management Permit, the Department seeks comments prior to making a final decision.
