Notice of Complete Application

The New York State Department of Environmental Conservation (NYS DEC) proposes to issue General Permit GP-0-16-004 - Removal/Modification of Recent Beaver Dams, for the modification or removal of recently established beaver dams no more than 2 years old. This permit is applicable to regulated freshwater wetlands, including the wetland adjacent area, outside the Adirondack Park, and to protected waterways throughout New York State. This permit will only be valid when issued concurrently with a Nuisance Beaver Permit pursuant to ECL Article 11-0521, and this permit expires concurrently with the Nuisance Beaver Permit.

Permits Applied for: Article 24 Freshwater Wetlands; Article 15, Title 5 Stream Disturbance; Article 15, Title 5 Excavation & Fill in Navigable Waters; Section 401- Clean Water Act Water Quality Certification.

Project Location: NYS DEC Regions 3 through 9

State Environmental Quality Review: Project is a Type II Action.

Final Amendment No. 1 to the FFY 2016 CWSRF Intended Use Plan

The New York State Environmental Facilities Corporation (NYS EFC) and the New York State Department of Environmental Conservation (NY DEC) announce that the Federal Fiscal Year (FFY) 2016 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF), dated November 2015, is amended.

Final Amendment No. 1 addresses these issues:
1. Revisions to the FFY 2016 Annual Project Priority List
2. Green Innovation Grant Program Round 7 projects
3. Smart Growth review of projects added to the Final 2016 Annual List
4. Modification of Sources and Uses
5. Modification to Section 4.4.5 to add Target Service Charge formula
6. Funding of stormwater projects

NYS EFC received no comments on the Draft 2016 CWSRF IUP Amendment No. 1. The Final Amendment No. 1 is available on the NYS EFC website at: www.efc.ny.gov.

Final Amendment No. 2 to the Drinking Water State Revolving Fund (DWSRF) Federal Fiscal Year (FFY) 2016 Intended Use Plan

FFY 2016 DWSRF Intended Use Plan Amendments:

Draft Amendment No. 2 to the Drinking Water State Revolving Fund Intended Use Plan (IUP) issued October 1, 2015 was published in the April 6, 2016 issue of the Environmental Notice Bulletin (ENB). The comment period for Draft Amendment No. 2 closed on April 20, 2016 and the New York State Department of Health (NYS DOH) received no public comments pertaining to the Amendment. Therefore, as of April 21, 2016 the Amendment as shown below was final:

DWSRF#18084 Brocton (V), Chautauqua County - The project cost as listed in the DWSRF Intended Use Plan (IUP) is increased to $1,996,120. This increase reflects potential additional funds that may be required for the financing of the project and allow associated fees to be rolled into the financing. The increased costs are subject to repayment to the program over the term of the financing.

DWSRF#18096 Orleans (T), Jefferson County - The project cost as listed in the DWSRF Intended Use Plan (IUP) is increased to $13,251,488 to reflect potential additional funds that may be required for the financing of the project. The cost increase is a result of expanding the project to serve additional homes with public water. The increased costs are subject to repayment to the program over the term of the financing.

DWSRF#18098 Rome (C), Oneida County - The project cost as listed in the DWSRF Intended Use Plan (IUP) is increased to $15,307,000 to reflect the additional funds that are required for the financing of the project. The cost increase is a result of the actual project bids coming in higher than the original estimates. The increased costs are subject to repayment to the program over the term of the financing.

In addition to the above project specific amendments, Section 7.3 of the IUP is amended to remove the 4th bullet under Hardship Eligibility Criteria. The language being removed by this amendment is "Construction is not substantially complete on the project at the time of the initial DWSRF financing."

NYS DOH has determined that the amendments are necessary, reasonable, and in the interest of protecting public health. The amendments will not adversely affect any project on the IUP Project Annual List above the subsidized funding line. Except as noted above, there are no other changes to the IUP as a result of this Amendment No. 2 of the FFY 2016 IUP.
