Project Description:

The Department has made a tentative determination to approve an application for the use of Rodeo, a registered pesticide for the control of aquatic plants, to control the invasive species Water Chestnut within NYS Freshwater Wetland JA-4 (Class 1). The herbicide application will be accomplished using an airboat to access shallow areas, inaccessible by other means. In addition, the applicant proposes to continue water-level management of the Nature Center's five impoundments located within the NYS Freshwater Wetland. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. The project is located at the facility address listed above.

Project Description:

The Department has received and made a tentative determination to approve an application for an approximately 150 lot subdivision between Roll Road, Greiner Road, Shimerville Road and Thompson Road in the Town of Clarence. The project will involve 0.08 acre of impact to NYS Freshwater Wetland (FWW) LA-8 and 1.64 acres of impact to the regulated adjacent area of FWW LA-8. These impacts are associated with construction of approximately 1200 linear feet of road to connect the subdivision to Roll Road. As mitigation for these impacts, 0.12 acre of vernal pools will be constructed and 180 shrubs and 51 trees will be planted in the road right-of-way to enhance buffering capacity. The project also involves a road and utility crossing of a Class C(T) tributary of Gott Creek. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

SEQR Lead Agency: Clarence Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to approve an application for the installation of a new lawn within the regulated 100 foot adjacent area of New York State Freshwater Wetland TE-35 located on Forest Glen in the Town of Wheatfield. The project will involve grading and clearing an approximately 0.10 acre area. A 40 foot buffer will be maintained between the lawn area and the boundary of Freshwater Wetland TE-35. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.
