Project Description:

The Department has made a tentative determination to approve an application for a Mined Land Reclamation permit. The applicant, Fuller's Excavation LLC., proposes to develop and operate a 32 acre sand and gravel mine within a 174.96 acre parcel of land owned by Scott Glezen. The proposed mine will be located at 320 Owen Hill Rd. Mining is not proposed below the water, and will be done by temporary, portable equipment for crushing, screening and weighing onsite. Material washing will not take place at the site. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a 19.9 acre uniformly graded open farm land.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Applicant proposes to expand the existing sand and gravel mine downward from a previously approved mine floor elevtion of 1020 feet to 990 feet which would be more level with the adjacent NYS Rte 12. No mining below the water table is proposed. Reclamation will continue to be to a commercial use on the mine floor with topsoiled and seeded stable side slopes.

Project Description:

The applicant is proposing to modify the current State Pollutant Discharge Elimination System (SPDES) permit for the Town of Nichols Sewage Treatment Plant located at 3626 East River Road in the Town of Nichols, Tioga County. The proposed modification is to expand the current facility design flow of sanitary and industrial wastewater to 0.245 MGD of which 0.19 MGD is industrial wastewater, to Susquehanna River, a Class B waterbody. The proposed process will consist of a new headwork structure, a new two-train Sequencing Batch Reactor (SBR) designed for nutrient removal, a cloth media filter, and a hypochlorite disinfection system. The old SBR structure will be repurposed as a decant equalization basin and an aerobic sludge holding basin. The expansion is to allow the plant to receive and treat industrial discharges from a can manufacturing facility (Crown Cork and Seal).

The Department has made a tentative determination to issue a permit for a SPDES permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval or endorsement of the activity for which a permit is sought or for the overall proposed project. State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
