Negative Declaration

Broome County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Fuller-Glezen Mine will not have a significant adverse environmental impact. The applicant, Fuller's Excavation LLC., proposes to develop and operate a 32 acre sand and gravel mine within a 174.96 acre parcel of land owned by Scott Glezen. The proposed mine will be located at 320 Owen Hill Road on the northeast side of Owen Hill Road just northwest of the Town of Lisle, New York. The mine is intended to operate as a surface extraction of the Chenango and Howard gravelly loam which is predominate soil type on the site. Mining is not proposed below the water, and will be done by temporary, portable equipment for crushing, screening and weighing onsite. Material washing will not take place at the site. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Mining is proposed to remove approximately 134,440 cubic yards per year of aggregate sand and gravel over the estimated 15 year operational life-of-mine. The reviewed Life-of-Mine area is 32 acres. Final reclamation will restore the site to a 19.9 acre uniformly graded open farm land.

Positive Declaration

Tompkins County - The Town of Danby, as lead agency, has determined that the proposed Rezoning of Planned Development Zone 10 (Summit Enterprise Center) may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared.

The applicant has proposed rezoning of Planned Development Zone 10 (formerly known as Angelheart Design), from the currently permitted commercial use (clothing manufacturer) on 9.22 acres under Local Law 1 of 1997 to a mixed-use business incubator with a 8,750 square foot future addition, JLF Holdings, LLC, Owner, David Hall, Applicant. The Town Board has determined that there is likely to be adverse environmental impacts to the elements that were identified, namely to groundwater, to the community long-term through growth inducement, and to significant potential changes to community character. The project is located at 279-303 Gunderman Road in the Town of Danby, New York.
