State Pollutant Discharge Elimination System (SPDES) General Permit for Point Source Discharges to Surface Waters of New York from Pesticide Applications

Permit No. GP-0-16-005

The New York State Department of Environmental Conservation (NYS DEC) is making the draft renewal of the SPDES General Permit for Point Source Discharges to Surface Waters of New York from Pesticide Applications (GP-0-16-005) and Fact Sheet available for public review. The Pesticide SPDES General Permit will authorize point source discharges to, in or over surface waters of New York State from the application of New York State registered pesticides labeled for aquatic uses in accordance with Environmental Conservation Law and the Clean Water Act.

State Environmental Quality Review (SEQR): Project is not subject to SEQR because it is a Type II Action.

New York State Department of Environmental Conservation (NYS DEC) has updated its Guidelines for Conducting Bird and Bat Studies at Commercial Wind Energy Projects (Guidelines). The Guidelines were last revised August 2009, and the recommended methods and analyses described in this April 2016 draft are based on NYS DEC's current knowledge of the best procedures for conducting thorough and meaningful pre- and post-construction studies.

The most recent updates to the Guidelines dated April 2016 include the following:

• Changes to the general wording of NYS DEC's recommendation process.
• Editorial changes to improve the flow of the document.
• Expanded discussion of habitat fragmentation impacts.
• Inclusion of studies for recently state-listed species.
• Expanded discussion of avoidance, minimization and mitigation measures.

NYS DEC will be accepting comments on the updated Guidelines until May 20, 2016.
