Project Description:

The applicant proposes to develop and operate a 4.8 acre sand and gravel mine within a 74.5 acre parcel of land owned by the applicant. The project site is on the south side of the Brouse Road and the west side of NY State Highway 420, approximately 1,300 feet south of the intersection of NY State Highway 420 and the Brouse Road in the Town of Norfolk. The mine is intended to operate as a traditional surface extraction of the Swanton Fine Loamy Sand, which is the predominate soil type on the site. Mining is proposed for below the local water table. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations, and for removal of material below the local water table. Mining is proposed to remove approximately 8,000 tons-per-year of aggregate sand and gravel over the estimated 5 year operational life of the mine. Material will be stockpiled as unprocessed "run-of-bank", or processed with portable screens and crushers. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a 4.0 acre open water surface within uniformly graded and re-vegetated open land. Up-land reclamation will include the replacement of stockpiled topsoil, and re-seeding with an approved USDA SCS seed mixture. The reviewed life-of-mine expansion area is 4.8 (LOM) acres.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
