The New York State Department of Environmental Conservation (DEC) has received an application for a new State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, for the subsurface discharge of up to 21,744 gallons per day of treated sanitary waste through a community septic tank and absorption field treatment system. The proposed community wastewater system will be operated by Dutchess County Water Wastewater Authority (DCWWA) with the County forming a County Zone of Assessment. The community wastewater system will serve Red Hook Acre LLC's proposed 52 acre Hoffman Traditional Neighborhood Development Project consisting of 102 dwelling units, and Community Center.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V permit renewal for the Shoemaker Gas Turbine Facility located in Middletown, Orange County.

The Shoemaker Gas Turbine Facility is a peak generating station that operates one simple cycle gas turbine rated at 512 mmBtu/hr that may fire natural gas, jet fuel A, distillate oil and biodiesel. Additional combustion sources on-site include one natural gas-fired internal combustion engine (compressor) rated at 560 kW and one natural gas-fired emergency generator rated at 45 kW.

No changes to the facility's emission limits have been made. A new cap on annual hours of operation has been added to support the economic analysis included in the updated NOx RACT, approved in March 2016. The facility is subject to certain conditions under the following regulations: 6 NYCRR Parts 200, 201, 202, 211, 215, 225-1, 227-1, 227-2, 242-1 and 40 CFR Parts 63 (Subpart ZZZZ), 68, 82 (Subpart F) and 97.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
