Notice of Public Comment Period

Proposed Surface Restrictions Variance

Project Description and Location: The New York City Department of Environmental Protection (NYC DEP) has applied for a well permit and variance to the surface restrictions requirements set forth in Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6 NYCRR), Section 553.2, to drill the B-5 (API 31-119-30002-00-00) stratigraphic well in the Town of Mount Pleasant, Westchester County, New York.

NYC DEP proposes to drill the well as part of a geotechnical investigation for the Kensico-Eastview Connection Tunnel, but needs variances from the surface restrictions provisions set forth under 6 NYCRR §553.2. As proposed, Well B-5 is less than 75 feet from the nearest road. The New York State Department of Environmental Conservation (NYS DEC) proposes to approve the well spacing variance.

Public Comment Period: All persons, organizations, corporations or government agencies which may be affected by the proposed Project are invited to submit written comments. The public comment period will remain open until Wednesday, April 27, 2016. Written comments should be submitted to: Thomas E. If no substantive and significant issues are identified regarding the proposed variance at the end of the comment period, NYS DEC will issue a permit to drill the B-5 well at the proposed location subject to site-specific conditions as warranted.

Negative Declaration

Ulster County - The Kingston Board of Water Commissioners, as lead agency, has determined that the proposed Kingston Water Transmission Main Rehabilitation Project will not have a significant adverse environmental impact. The action involves the remediation of identified deficiencies and vulnerabilities in segments of its water transmission mains to ensure the continued delivery of both drinking water and fire flows to the City of Kingston through the installation of new mains, replacement valves for isolation and flow control, and the installation of structural lining at vulnerable locations. The system of transmission mains is critical to the continuous supply of water to the City of Kingston. This project proposes to improve the reliability and functional integrity of this infrastructure. The project is at various locations in the Towns of Woodstock, Kingston, and Ulster, New York.
