Project Description:

The applicant proposes to develop and operate a 16 acre sand and gravel mine within an 18 acre parcel of land owned by the applicant. The project site is on the west side of US Rte 11 approximately ¼ mile north of the intersection of US Rte 11 and Michael Road in the Town of Adams. The mine is intended to operate as a traditional surface extraction of the Groton gravelly loam, which is the predominate soil type on the site. Mining is proposed for below the local water table. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations, and for removal of material below the local water table. Mining is proposed to remove approximately 40,000 tons-per-year of aggregate sand and gravel over the estimated 10 year operational life of the mine. Material will be stockpiled as unprocessed "run-of-bank", or processed with portable screens and crushers. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a 16 acre open water surface within uniformly graded and re-vegetated open land. Up-land reclamation will include the replacement of stockpiled topsoil, and re-seeding with an approved USDA SCS seed mixture. The reviewed life-of-mine expansion area is 16 (LOM) acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Stabilize the road slope on the shoreline of the St Lawrence River by placing large rock rip rap in various locations along County Route 6 between the Tibbets Point Lighthouse and the Village of Cape Vincent.

No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

DEC received a request for a permit renewal to operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a Title V Facility Permit, for the WM Oneida Herkimer Renewable Energy Facility (WMRE LFGTE Plant) located in the Town of Ava, Oneida County, New York. This facility is engaged in the generation of electricity from the combustion of landfill gas captured at the Oneida Herkimer Solid Waste Management Authority (OHSWMA) Regional Landfill. The Standard Industrial Classification representative of this facility is 4911, Electric Services.

This Title V Permit is for a landfill gas to energy (LFGTE) plant consisting of three (3) Caterpillar 3520C landfill gas engine generator sets to be owned and operated by Waste Management Renewal Energy (WMRE), LLC (DEC Title V Permit ID: 6-3024-00009/00007). The LFGTE plant will be the primary control system for landfill gas generated by the OHSWMA Regional Landfill. OHSWMA Regional Landfill (DEC Title V Permit ID: 6-3024-00025/00001) and WMRE, LLC will hold separate Title V Air Permits; however, for the purposes of New Source Review (NSR) applicability they are considered a single facility and will share a common emission cap for combined carbon monoxide (CO) and oxides of nitrogen (NOx) emissions to ensure the facility does not exceed the major facility threshold.

All engines will be required to meet emissions limits for oxides of nitrogen (NOx) and carbon monoxide (CO) and shall perform monitoring and recordkeeping to determine compliance with emission limits.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USE) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
