Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit renewal for the JML Quarries Masten Lake Plant located in Mamakating, Sullivan County. This renewal permit was initiated to reflect equipment replacement and incorporate a ten year expiration pursuant to 6NYCRR Part 201.

The JML Quarries Masten Lake Plant consists of a hot mix asphalt plant, a quarry, and a diesel generator used for backup electrical power. The hot mix asphalt plant utilizes number 2 oil or waste oil as fuel.

Emissions of carbon monoxide, nitrogen oxides, sulfur dioxide, and volatile organic compounds are limited in order to be below major source thresholds. Therefore, the facility is not subject to Title V permitting requirements. The facility is subject to 40 CFR 60 Subparts I, 40 CFR 60 Subpart OOO, and 6 NYCRR Parts 200, 201, 212, 225-1, 225-2, and 227-1.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

Persons wishing to inspect the subject files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal and set a standard five year term to State Pollutant Discharge Elimination Systems (SPDES) permit (NY0150452). Permit pages, limits, requirements, and general conditions have been updated and reflect current permit language, DEC guidance, format and nomenclature. This permit is for the surface discharge of 1,500 gpd of treated sanitary wastewater to a unnamed tributary of the Wallkill River, a class C water. Details of changes are specified in the draft permit and fact sheet.
